Reclaimimg legal expenses
Firstly Hello to all,

I have just joined Office Arrow and would like to introduce myself. I am a Financial Administrator for a small Transport and Distribution company located in Dumbarton Scotland. I was born in Glasgow and imigrated to New York as a baby with my parents. My formative years were spent in New York where I graduated High School and went on to College. I moved to Scotland in late 1979 to initially look after my granmother who was not keeping well and decided to stay,where I have been for the last 30 years approx.

Enough of myself for now. I have an employee who has been taking time off to deal with a personnel issue which is presently in the courts. The courts have awarded them expenses to which we (the company) have submitted an account for lose of earnings. We have received a response from the solicitors of the other party who we are claimimg the loss of earning from, who inform we are only intitled to claim 2/3rd's of the figure which a solicitor would have been entitled to charge for appearing in court and not the actual losses incurred.

I have gathered from brieflly looking over this website that the majority of the correspondance I have read originated in the good old USA and that this will probably not pertain to the legally system in the US . However if anyone has any understanding of the Scottish legal system and could be of assistance in this matter it would be greatly appreciated.

Fiona,

I don't know the Scottish legal system and wouldn't pretend to, but hopefully we have a member or two who can point you in that direction. I would ask your own lawyers here in the U.S. (assuming you have a firm your company uses) or even check with your insurance carrier, again assuming you have one. Sorry I can't give you more help, but hope that's at least a start. Thanks for being part of OfficeArrow.

Well, we have a growing community here and over time we will hopefully get more folks from around the globe to help. Check with your lawyers and then if you can share what you find so we can build the knowledge base here - sorry we couldn't help you this time but keep coming back and it will only get better and better.
